"I find evidence prima facie established against the accused, so I call upon the accused to enter his defence," judge Diah told the Court.

He said that he believed that Mohamad Saiful Bukhari Azlan, the 23-year-old man who accused Anwar of sodomising him, was a reliable witness.

"There is nothing implausible about his testimony." His testimony is reliable, said the judge.

He also concluded there was evidence that Mr Anwar and Mr. Saiful were at the scene of the crime attributed to the time in question and that there were "opportunity for the offence that allegedly took place."

The judge had previously reversed a decision to allow the key to the DNA evidence which had been banned to have been collected illegally when Mr Anwar was held in a police cell.

"It is clear that the arrest of Mr Anwar] was lawful and the detention was a legitimate purpose," said the judge.

The prosecution argues that the DNA of the elements would link Mr Anwar semen on his accuser, Mr. Azlan.

No acquittal decision not Mr Anwar is not surprising to his supporters, who insist on the fact that the charge of sodomy is forged by his political enemies, said the BBC Jennifer Pak in Kuala Lumpur.

The allegation surfaced just surface a few months after Mr. Anwar led the opposition won an unprecedented number of seats in the 2008 elections, says our correspondent.

Human Rights Watch said the charges should be removed and that the case is a "charade of justice".

Mr Anwar was imprisoned separate sex and accusations of corruption in 1998 and released on appeal in 2004.

Malaysia to take 800 asylum of Australia

KUALA LUMPUR, Malaysia - Malaysia will accept 800 asylum seekers who entered Australia illegally by sea in an innovative agreement between the two countries to tackle smuggling.

In return, the Australia will resettle 4,000 registered refugees living in Malaysia, according to a joint statement late Government Saturday.

The Australia has long attracted people from poor countries, often ravaged by war, in the hope of starting a new life, with more than 6 200 asylum seekers arriving in the country by boat last year. Most are Afghanistan, Sri Lanka, the Iran and the Iraq and uses the Indonesia or Malaysia as a starting point for a trip in the dangerous sea Australia.

Australia, will fully fund the arrangement, the joint statement said, adding that the pilot project aims to "undermine the model cases of transnational crime groups, especially in the smuggling and trafficking in human beings humans in this region.".

800 Persons transferred to the Malaysia will have their requests processed by the United Nations, and "those in need of international protection will not be repressed," said the statement.

The two countries will work closely with the United Nations High Commissioner for refugees and the International Organization for migration to implementation of the agreement, which will be finalized soon, he said.

Gillard, said the Australian Government has committed in talks with Papua Guinea to build a regional detention centre y to deal with asylum seekers, and that it would be financed by the Australia. An earlier proposal to establish such a centre in the neighbouring countries of East Timor was not favoured by the Government of that country.

Since the beginning of 2010, the Australia stopped more than 140 boats carrying asylum seekers. The Malaysia also took dozens of people engage in rickety and overcrowded boats in Australia.

SYDNEY- Prime Minister Julia Gillard, announced Saturday that the Malaysia has agreed to take hundreds of asylum seekers who illegally, land in Australia in a move described as a "big hit" to smugglers.

Under the bilateral agreement, up to 800 boat people trying to reach Australia is taken immediately to the Malaysia, with their applications processed it by the United Nations.

In return, the Australia agreed to accept and to reinstall, more than four years, 4,000 refugees enrolled currently living in Malaysia, Gillard and his Malaysian counterpart Najib Razak said in a joint statement.

"This historic agreement will help to bring that product smugglers attempting to sell - a ticket for the Australia,", said the Gillard.

"The key message that will invest in smugglers and those who seek to make the trip in the dangerous sea Australia are: get on the boat."

"Under this agreement, if you arrive in Australian waters and are taken into Malaysia you go to the back of the queue."

The agreement, which was negotiated with the Malaysian Government over the past seven months, should be finalized in the coming weeks with the Australia covering all the terms of financing.

Minister of immigration Chris Bowen said that 300 million cost of $ Aus ($320 million) over four years.

The figure of 800 is a total one-time without attached time limit.
